Claims for personal injury as a result of a criminal assault in Scotland are handled by the CICA based in London and Glasgow. Claims arising in Scotland, England or Wales are all dealt with under the same legislation and are determined from the same offices. Any incident must be reported to the police as soon as possible (see below) and medical treatment and advice should be obtained immediately after the assault. An application form must be submited within two years of the incident giving rise to the injury and this time limit will only be extended by the CICA in exceptional circumstances. Claims can be denied or reduced for a number of reasons the most common of which are failing to co-operate with the police investigation, the claimants behaviour before, during or after the incident and the claimants record of 'unspent' criminal convictions. Any intermediate decision by the CICA can be escalated to a higher claims officer for review and any final decision can be taken to an independent Appeal Panel. Maladministration by the Appeals Panel can be investigated by the Parliamentary Ombudsman. The amount of a Scottish criminal injury compensation award is determined by use of a tariff scheme whereby each type of trauma is assigned a tariff in one of 25 bands ranging in value from £1,000 to £25,000. The CICA will consider only three separate injuries and will discount the second and third most serious trauma before aggregating them to make a final award.
