No Win No Fee which is more formally called a Conditional Fee Agreement (CFA) works on the basis that the representative acting in the claim is only entitled to be paid his fee if he wins the case. If the case is lost then the representative will lose any fees that he may have earned and must write them off. Our claims are completely risk free and you will not be asked to fund or finance your claim as it proceeds. The Criminal Injury Board does not make any contribution towards legal costs and we only make a charge in the event of a satisfactory outcome resulting in payment of compensation. Legal Aid is not and never has been available for these applications.

The compensation payable by the CICA is determined by a tariff scheme whereby each injury or trauma is given a scale value. If there are multiple injuries only the worst three are considered and a reduction on a sliding scale is applied to the lesser two injuries. Certain other special expenses may be eligible for an award of compensation including lost earnings or earning capacity for longer than 28 weeks as a direct consequence of the injury.

In the event of a fatality caused by criminal activity there are a number of classes of people including dependents who can claim an award. The amount of award paid for a sole claimant is £11,000 however if there is more than one claimant the amount reduces to £5,500 per applicant. In addition a person who is not in one of these classes who has paid the funeral expenses can claim a reasonable amount to cover these expenses.

An application for compensation for physical or mental trauma must be made in writing to the Criminal Injury Board as soon as possible and certainly within two years of the date of the incident which caused the injury however a claims officer may waive this time limit but such discretion is only exercised in unusual circumstances where it is reasonable and in the interests of justice to do so.
