Q. Can I see the medical report and other written evidence?
A. Most of the written evidence is available for review following the initial
decision except the Police Report which is provided to the CICA on the basis it remains
confidential.
Q. How long will my criminal assault compensation claim take?
A. That depends on the complexity of the case but 90% of claims are settled within 10
months and the average time to resolution is 8 months.
Q. If an initial CICA decision is made on my case can I ask for it to be reconsidered?
A. A decision by a claims officer can be reviewed by a more senior member of staff at
the CICA. An application can be made after the notice of a decision has been received
using the form that accompanies the decision.
Q. Is there a time limit on when I can ask for the initial decision to be re-considered?
A. An application should be made within 90 days of the original decision however the
CICA does have discretion to extend this period in exceptional cases where it would best
serve the interests of justice.
Q. Can I appeal the decision of the senior officer who has reviewed a decision?
A. If you wish to contest the review decision, you are entitled to appeal to the
Criminal Injuries Compensation Appeals Panel, which is independent of the Authority. An
appeal form and a guide to appeal procedures are sent out with the written review
decision.
Q. Can I submit my own medical evidence?
Q. Can I claim for someone who has been killed by criminal activity.
A. There is a restricted class of potential claimants following a fatal injury which
includes parents, spouses, children and those in receipt of support from the deceased.
Q. Can I claim funeral expenses?
A. The CICA will pay reasonable funeral expenses to whoever has laid out for them
even though they may not come within the classes outlined above.
