Physical Sexual Emotional or Psychological Abuse

This is a serious national problem which can take the form of physical, sexual, emotional or psychological abuse which is often caused by neglect, lack of restraint or failure to provide appropriate services and treatment by the relevant authorities. Child abuse compensation can be claimed whether or not it was a one to one situation, a family problem or institutionalised abuse. The most vulnerable sections of society are those who are mentally disabled or where there the abuser is in a position of authority which often occurs in residential care homes, respite and day care organisations and schools which have in the past been a magnet for paedophiles. No Conviction Necessary

Significant numbers of adults have now come forward to the police and solicitors resulting in criminal convictions and custodial sentences giving rise to child abuse compensation claims. A conviction is not necessary however to succeed in a claim to the CICA provided that the applicant has fully co-operated with the investigating police officer. The CICA uses a tariff scheme for determining compensation and may reduce awards to claimants who have unspent criminal convictions determined by the Rehabilitation of Offenders Act on the basis that it is inappropriate to compensate offenders out of public funds.

No Time Limits
